1. Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("you," "your," or "Customer") and RV Prime Care, a brand operated by RV-Interiors, a proprietorship business owned by Mr. Arvind Kumar ("RV Prime Care," "we," "us," or "our"), governing your access to and use of the website rvprimecare.in and any purchase of products made through it (collectively, the "Website" or "Services").

By accessing the Website, creating an account, or placing an order, you agree to be bound by these Terms, along with our Privacy Policy, Shipping Policy, and Return, Refund & Cancellation Policy, each of which is incorporated into these Terms by reference. If you do not agree to these Terms, please discontinue use of the Website.

These Terms constitute an electronic record under the Information Technology Act, 2000, and do not require any physical or digital signature to be valid and binding.

2. Key Definitions

• "Products" means the salon furniture and related items listed for sale on the Website, including but not limited to styling chairs, trolleys, tables, and mirrors.
• "Order" means a request placed by you to purchase one or more Products through the Website.
• "Account" means the registered profile you create to place Orders and track them on the Website.
• "Content" means all text, images, graphics, logos, and other material published on the Website.

3. Eligibility

By using the Website, you represent and warrant that you are at least 18 years of age and are competent to enter into a binding contract in accordance with the Indian Contract Act, 1872. If you are placing an Order on behalf of a business, salon, or organisation, you represent that you have the authority to bind that entity to these Terms.

4. Account Registration & Security

You may be required to create an Account to place certain Orders, or you may check out as a guest. Where you create an Account, you agree to:

• Provide accurate, current, and complete information;
• Keep your login credentials confidential and not share them with any third party;
• Notify us immediately at rv.interiors01@gmail.com of any unauthorised use of your Account; and
• Accept responsibility for all activity that occurs under your Account, except where such activity results from our own negligence or a security failure on our part.

5. Products, Descriptions & Pricing

We make reasonable efforts to display our Products, including images, dimensions, materials, and specifications, as accurately as possible. However:

• Actual colours may vary slightly from what is displayed on your screen, depending on your device's display settings;
• Minor variations in upholstery finish, stitching, or hardware may occur between manufacturing batches, as our Products are crafted rather than mass-produced identically;
• Weights and dimensions listed are approximate and provided for guidance, particularly for shipping and space-planning purposes.

All prices are listed in Indian Rupees (₹) and, unless otherwise stated, are inclusive of applicable GST. We reserve the right to change prices at any time without prior notice; however, the price applicable to an Order already confirmed and paid for by you will not change. A tax invoice reflecting your GSTIN (where applicable and provided by you) will be issued with every Order.

6. Payment Terms

We currently accept the following payment methods, as displayed at checkout: Cash on Delivery (COD), Direct Bank Transfer (NEFT/RTGS/IMPS), and secure online payment via our payment gateway partner (where enabled). All online payments are processed directly by our payment gateway partner in a PCI-DSS compliant environment; we do not store your card, UPI, or net-banking credentials.

For Cash on Delivery Orders, payment must be made in full to our delivery partner at the time of delivery. We reserve the right to restrict or withdraw the COD option for certain pin codes, order values, or customers, at our discretion.

7. Order Acceptance & Cancellation

Placing an Order on the Website is an offer by you to purchase the selected Products. An Order is confirmed only once we send you an order confirmation via email, SMS, or WhatsApp. We reserve the right to refuse, cancel, or limit the quantity of any Order, including where:

• The Product ordered is out of stock or discontinued;
• There is an error in the price or Product description displayed on the Website;
• We suspect fraud, unauthorised, or illegal activity in connection with the Order; or
• Delivery to the address provided is not serviceable.

If we cancel a confirmed Order for any of the above reasons after payment has been received, we will issue a full refund to your original payment method within a reasonable time.

8. Shipping & Delivery

Detailed delivery timelines, serviceable areas, and shipping charges are set out in our Shipping Policy, which forms part of these Terms. In brief: delivery timelines are estimates and not guaranteed, given that our Products are bulky salon furniture items that require careful freight handling; risk of loss or damage passes to you upon delivery to the address provided, except where damage is due to our negligence or that of our logistics partner in transit, which is handled per our Return, Refund & Cancellation Policy.

9. Returns, Refunds & Warranty

Our detailed Return, Refund & Cancellation Policy and Warranty Policy set out the eligibility window, process, and conditions for returns, refunds, and manufacturing-defect coverage. Both policies form part of these Terms by reference. Products damaged due to misuse, normal wear and tear, or unauthorised repair are not covered.

10. Intellectual Property

All Content on the Website, including the "RV Prime Care" name, logo, and device mark (trademark application filed under Application No. 7807167, Class 20), product photography, descriptions, and website design, is the property of RV-Interiors or its licensors and is protected under applicable Indian trademark, copyright, and intellectual property laws. You may not reproduce, copy, distribute, or create derivative works from any Content without our prior written consent.

11. Prohibited Use

You agree not to:

• Use the Website for any unlawful purpose or in violation of any applicable Indian law;
• Attempt to gain unauthorised access to the Website, its servers, or any connected systems;
• Use any automated system (bots, scrapers) to extract data from the Website without our written permission;
• Place fraudulent Orders or provide false information at checkout; or
• Interfere with the proper functioning of the Website or its security features.

12. Product Liability & Disclaimers

We stand behind the quality of our Products and, in accordance with the product liability provisions under Chapter VI of the Consumer Protection Act, 2019, are responsible for manufacturing defects as set out in our Warranty Policy. Except as expressly stated in our Warranty Policy, Products are provided without any other warranty, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, to the extent permitted by applicable law. The Website itself is provided on an "as is" and "as available" basis, and we do not guarantee that it will be uninterrupted, timely, or error-free.

13. Limitation of Liability

To the maximum extent permitted by applicable law, RV Prime Care's total liability to you arising out of or relating to these Terms or any Order shall not exceed the amount actually paid by you for the relevant Order. In no event shall we be liable for any indirect, incidental, special, or consequential damages, including loss of business or business interruption at your salon, arising from the use of, or inability to use, our Products or the Website. Nothing in this section limits any liability that cannot be excluded or limited under applicable Indian law.

14. Indemnification

You agree to indemnify and hold RV Prime Care, its proprietor, and its representatives harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Website, or your violation of any applicable law or third-party right.

15. Force Majeure

We shall not be liable for any delay or failure in performing our obligations under these Terms where such delay or failure results from circumstances beyond our reasonable control, including natural disasters, fire, strikes, transport disruptions, pandemics, or government action.

16. Grievance Redressal

In accordance with the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, and the Information Technology Act, 2000, the details of our Grievance Officer are set out below. As RV-Interiors operates as a sole proprietorship (an inventory-based seller, not a marketplace entity), the requirement to appoint a separate nodal officer under the 2021 clarification to the E-Commerce Rules does not apply to us; the Grievance Officer below handles all consumer complaints.

17. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable consumer-protection law (which may permit you to approach a consumer forum having jurisdiction over your own place of residence), any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Delhi, India.

18. General Provisions

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Return, Refund & Cancellation Policy, constitute the entire agreement between you and RV Prime Care regarding your use of the Website, superseding any prior agreements.

No Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.

19. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our business practices or applicable law. The updated Terms will be posted on this page with a revised "Last Updated" date and will apply to Orders placed after the date of update. We encourage you to review this page periodically.
